This document is a public offer by Individual entrepreneur Alexey Nikolaevich Bystritsky, OGRNIP 320508100228680, INN 500506911869 (the “Provider”), and sets out the terms of use of the Cook My Fridge service.

1. Definitions

1.1. Cook My Fridge — the mobile application, website, web pages, interfaces and other technical means provided under the name Cook My Fridge.

1.2. User — an individual who uses the Service and/or pays for access to its paid features.

1.3. Cook My Fridge Premium — paid access to the extended features of the Service under the selected plan.

1.4. User Materials — photos, text and voice requests, product lists and other data the User submits to the Service.

2. Subject of the offer

2.1. The Provider grants the User access to the Service, which recognises products and dishes from photos, suggests recipes and keeps a calorie diary.

2.2. The Service uses automated recommendation technologies and artificial intelligence models. Their use is described in the Recommendation technology rules and on the “Data shared with AI providers” page.

2.3. The Service is not a medical device. Calorie, nutrition and ingredient information is provided for reference only, is calculated automatically and does not replace advice from a doctor or a dietitian.

3. Acceptance

3.1. Any use of the Service — installing the app, launching it, using its features or taking out a Subscription — constitutes acceptance of this offer.

3.2. A User who does not agree with these terms must stop using the Service.

4. Terms of use

4.1. The Service is provided “as is”. The Provider does not warrant that product recognition, dish recognition or calorie calculation will be free of errors.

4.2. The User undertakes:

• not to submit materials they do not hold the rights to;
• not to use the Service for unlawful purposes;
• not to attempt to access other people’s data, disrupt the Service or bypass technical restrictions;
• to judge for themselves whether products and dishes are fit to eat.

4.3. The User understands that dietary decisions are made by the User at their own risk, including where allergies, intolerances or medical conditions are involved.

4.4. The Service has no accounts and no sign-up. The User is identified by an anonymous installation identifier and, when paying, by the email address the User provides.

5. Paid features and Subscription

5.1. Some features of the Service are free, others require a Subscription.

5.2. A Subscription is taken out through an app store (App Store, Google Play) or, where the store reports the User’s currency as Russian roubles, through the payment provider CloudPayments.

5.3. Automatic charges made through CloudPayments are governed by a separate document — the Recurring payments offer: https://cookmyfridge.app/en/payments.

5.4. Where payment is made through an app store, subscription, renewal and refund terms are governed by the rules of that store.

6. Price and payment

6.1. The price, billing period and duration of the paid period are shown on the payment screen before payment.

6.2. Prices may change for future periods. The current paid period is provided on the terms in force at the time of payment.

7. Refunds

7.1. Payments made through an app store are refunded under that store’s rules.

7.2. Payments made through CloudPayments are refunded as described in the Recurring payments offer: https://cookmyfridge.app/en/payments.

8. Intellectual property

8.1. Exclusive rights to the Service, its interfaces, texts, images, recipe collections and source code belong to the Provider.

8.2. Rights to User Materials remain with the User. The User grants the Provider the right to process the Materials as far as necessary to operate the Service, including passing them to artificial intelligence providers for recognition and recipe selection.

8.3. User Materials are not used to train artificial intelligence models, are not sold and are not used for advertising.

9. Personal data

9.1. Personal data processing is described in the Privacy Policy: https://cookmyfridge.app/en/privacy.

10. Liability

10.1. The Provider is not liable for the consequences of decisions the User makes on the basis of information from the Service, including the consequences of eating any product or dish.

10.2. The Provider is not liable for interruptions caused by third parties, connectivity failures, app stores, payment providers or artificial intelligence providers.

10.3. The Provider’s liability is in any event limited to the amount paid by the User for the Subscription for the period in which the claim arose.

11. Changes to this offer

11.1. The Provider may amend this offer unilaterally. A new version takes effect when published on the Website.

11.2. Continued use of the Service after the changes take effect constitutes acceptance of the new version.

12. Enquiries and disputes

12.1. Enquiries should be sent to: alexey.bystritsky@gmail.com.

12.2. Enquiries are answered within 30 calendar days of receipt.

12.3. Disputes are resolved under the laws of the Russian Federation.
