Recurring payments offer

This document is a public offer by Individual entrepreneur Alexey Nikolaevich Bystritsky, OGRNIP 320508100228680, INN 500506911869 (the “Provider”), and sets out the terms for setting up, using, renewing and cancelling recurring payments for the Cook My Fridge Premium subscription.

This Recurring payments offer forms an integral part of the Cook My Fridge public offer published at https://cookmyfridge.app/en/oferta.

1. Definitions

1.1. Cook My Fridge — the mobile application, website, web pages, interfaces and other technical means provided under the name Cook My Fridge.

1.2. User — an individual who uses the Service and/or pays for access to its paid features.

1.3. Cook My Fridge Premium — paid access to the extended features of the Service under the plan selected by the User.

1.4. Recurring payment — an automatic periodic charge to the User’s bank card or account to renew the Subscription without re-entering payment details.

1.5. Initial payment — the first payment made when the Subscription is taken out.

1.6. Payment provider — the organisation that technically enables payments and recurring charges.

2. Subject

2.1. This offer sets out how an auto-renewing Subscription is taken out, how charges are made, and how the Subscription is cancelled and refunded.

3. Acceptance

3.1. This offer is accepted when the User does all of the following:

• selects a Cook My Fridge Premium plan;
• reviews the amount and frequency of future charges;
• ticks a separate checkbox agreeing to a Subscription with automatic charges;
• ticks a checkbox accepting this offer, the public offer and the Privacy Policy;
• presses the payment button;
• successfully completes the Initial payment.

3.2. By ticking the checkbox agreeing to the Subscription, the User confirms that they:

• understand that the Subscription renews automatically;
• understand the amount and frequency of future charges;
• agree to automatic charges;
• understand how to cancel the Subscription;
• understand that cancelling stops future charges but does not always mean an automatic refund of amounts already charged.

3.3. Consent must not be pre-selected. The User must give it themselves.

3.4. A User who does not agree with these terms must not take out an auto-renewing Subscription.

4. Price, frequency and term

4.1. The price, charge frequency and duration of the paid period are shown on the payment screen before the Initial payment.

4.2. Example plan terms:

• Cook My Fridge Premium — 490 RUB per month. The Subscription renews automatically every month until cancelled by the User.
• Cook My Fridge Premium — 2890 RUB per year. The Subscription renews automatically every 12 months until cancelled by the User.

4.3. If the payment screen shows a different price, currency, frequency or duration, the terms shown to the User on the payment screen at the time of purchase apply.

4.4. The Provider may change the price for future periods. A new price applies only after notifying the User, where such notice is required by applicable law, by the payment provider’s rules or by the terms of the Service.

4.5. The current paid period is provided on the terms in force at the time of payment.

5. How charges are made

5.1. The Initial payment is charged when the Subscription is taken out.

5.2. Subsequent payments are charged automatically according to the selected plan and frequency.

5.3. To make recurring payments the payment provider may store a payment token or another technical identifier of the card or account. The Provider does not store full bank card details.

5.4. Recurring charges are made without the User re-entering payment details.

5.5. If a charge cannot be made, the Provider and/or the payment provider may retry it and may suspend, restrict or terminate the User’s access to paid features.

5.6. The User’s payment obligation is considered fulfilled once the payment provider confirms a successful payment.

6. Cancelling the Subscription

6.1. The User may cancel the Subscription at any time.

6.2. The Subscription can be cancelled:

• in the Cook My Fridge app, in the subscription management section;
• through the CloudPayments subscription management service at https://my.cloudpayments.ru/;
• by writing to the Provider at alexey.bystritsky@gmail.com.

6.3. When writing by email, the User should provide details that identify the Subscription and the payment:

• the email used for payment;
• the payment date;
• the payment amount;
• the last four digits of the bank card if required;
• any other details needed to identify the payment.

6.4. Cancelling stops future charges.

6.5. After cancellation, access to paid features may remain until the end of the period already paid for, unless the plan terms or applicable law provide otherwise.

6.6. The User must cancel before the next charge date if they do not wish to renew.

6.7. The Provider is not liable for a charge made before a cancellation request was actually processed, where the User sent the request immediately before the charge date and it was technically impossible to process it in time.

7. Refunds

7.1. The User may request a refund at alexey.bystritsky@gmail.com.

7.2. Refund requests are considered individually, taking into account the circumstances of the payment, whether access to paid features was provided, how soon the request was made, technical payment data and applicable law.

7.3. A refund request should state:

• the email used for payment;
• the date and amount of the payment;
• the reason for the request;
• the last four digits of the bank card if required;
• any other details needed to identify the payment.

7.4. If the User received access to paid features and started using the Subscription, the Provider may refuse a full or partial refund, except where a refund is required by law.

7.5. Erroneous, duplicate or technically incorrect charges are considered separately. Confirmed errors are refunded.

7.6. Refunds are made by the same method as the payment, unless the parties agree otherwise or the payment provider’s rules require otherwise.

7.7. The time it takes for funds to arrive depends on the User’s bank, the payment system and the payment provider.

8. Payment data

8.1. The Provider does not store full bank card details.

8.2. Bank card details are processed by the payment provider and/or the acquiring bank under their rules, security requirements and applicable law.

8.3. Recurring payments may use a payment token or another technical identifier that allows subsequent charges without re-entering payment details.

8.4. The User understands and agrees that payment data may be passed to the payment provider, banks, payment systems and other participants in the settlement process.

9. Notices

9.1. The Provider may send the User notices about the Subscription, payments, cancellation, refunds, changes to the terms, technical matters and security.

9.2. Notices may be sent through the Service interface, by email, by push notification or through other available channels.

9.3. The User is responsible for keeping their contact details up to date.

10. Restricting access on non-payment

10.1. If a recurring payment fails, the Provider may:

• temporarily restrict access to paid features;
• suspend the Subscription;
• stop providing paid access;
• invite the User to retry the payment or choose another payment method.

10.2. Restricting or ending paid access does not affect the free features of the Service, where available to the User.

11. Changes to this offer

11.1. The Provider may amend this offer unilaterally.

11.2. A new version takes effect when published on the Website, unless the new version states otherwise.

11.3. Continued use of the Subscription after the changes take effect constitutes acceptance of the new version.

11.4. Changes that worsen the User’s position in respect of a period already paid for do not apply to that period, unless applicable law provides otherwise.

12.2. Where this offer conflicts with the public offer on automatic charges, this offer prevails.
